An elderly man suffered a delay in the diagnosis of his colon cancer. Further, once the cancer was diagnosed, the surgeon failed to recognize an injury to the patient's spleen which had occurred during the surgery to remove the cancerous portion of the colon. As a result, the patient died.

The family received $1,100,000 in compensation.
